Purchasing procedures

Our General Conditions of Sale

The customer confirms that they are of legal age and have the legal capacity to enter into a contract. In order to purchase the Vehicle, the Customer must follow a number of steps as described below:

ARTICLE 1 – ORDER CONDITIONS

1- ORDER VALIDATION

The customer submits the documents required to validate the order, including a copy of their identity card, proof of address, and payment of the shipping costs (€1,000) to validate the order with the electronic signature of the entire contract documentation (hereinafter referred to as the “Purchase Form”). Only documents sent by the customer and required to be retained in accordance with applicable regulations will be archived by the company.

 

2- DEPOSIT

The customer confirms these general terms and conditions and the warranty conditions.

The customer has three options:

*The customer pays 20% of the price as a security deposit. The security deposit will be deducted from the price upon full payment of the vehicle. 70% (excluding VAT) is paid on the day of delivery of the vehicle in the destination country or 15 days after delivery of the vehicle to your home.

*The customer receives a 5% discount on the total price when they place a 50% security deposit.
70% (excluding VAT) is paid on the day of delivery or 15 days after delivery of the vehicle.
*Receive a 10% discount by paying in full at the time of ordering.

*For payment by installments (with financing): To benefit from this payment method, after reviewing and agreeing to the customer’s eligibility, the customer must be able to make a minimum initial deposit of 30%. The remaining balance will be spread over a maximum of 60 monthly payments.
Important: Payment by installments is only available for vehicles with a value greater than or equal to €5,000.

*A single payment is required for vehicles with a listed price less than or equal to €5,000.

3 – REGISTRATION AND ADMINISTRATIVE PROCEDURES

New or used motorhomes, vans, or minivans are included in the VASP (Specialized Motor Vehicles) category. You are therefore not required to pay any environmental taxes. Our company takes care of all the administrative formalities up to the final registration (this also applies to VT passenger cars). A salesperson, agent, or delivery person will be designated to invoice for delivery and administrative formalities.

4-DOCUMENTS

The vehicle is delivered with a maintenance log, maintenance invoices, COC, temporary registration document, roadworthiness test, and mileage certificate.

 

ARTICLE 2 – RIGHT OF WITHDRAWAL
1/ EXERCISING THE RIGHT OF WITHDRAWAL

The Customer has a period of fourteen (14) days from the delivery of the Vehicle to exercise their right of withdrawal, without having to justify their decision or pay any penalties. Customers who wish to cancel their order must send the Company the cancellation form, duly completed in the order form, within the aforementioned period. The customer must be able to prove that they have exercised their right of withdrawal.

 

2/ RETURN OF THE VEHICLE

Customers exercising their right of withdrawal must, when returning the vehicle, return all documents and accessories that were provided to them upon delivery of the vehicle and that are listed on the delivery note. The Company will collect the returned Vehicle from the place where it was delivered. The Company will then inspect the vehicle and draw up a collection report. The vehicle will be inspected on the basis of the documents relating to the condition of the vehicle provided to the customer at the time of ordering and on the basis of the delivery note. Any sums owed by the Customer for damage caused to the Vehicle will be deducted directly from the compensation. If the number of kilometers traveled since delivery exceeds 500 kilometers, the Customer must reimburse the Company for each kilometer exceeding this threshold at a rate of €1 per kilometer including tax.  The amounts owed by the customer for excess mileage will be deducted directly from the refund.

In the event of withdrawal and in accordance with Article L221-23 of the Consumer Code, the customer will be responsible for all costs associated with returning the vehicle. The amounts that the Customer is required to pay for the costs of returning the Vehicle will be deducted directly from the compensation.

However, if the Customer returns the Vehicle to one of the Company’s establishments (this option is only available for certain Vehicles) or to the dealer, no return costs will be charged to the Customer. In the event of withdrawal, the Customer must return the Vehicle within 14 days of delivery of the Vehicle. Please note that all the provisions of this article do not apply to legal entities or individuals acting in the course of their commercial, industrial, craft, liberal or agricultural activities.

 

3/ REFUND

Exercising the right of withdrawal under the conditions set out above will result in the refund of the sums paid by the customer for the purchase order (hereinafter referred to as the “Refund”) within 14 days of receipt of the cancellation notice. The amount paid by the customer will be automatically increased by 10% if the refund is made no later than thirty days after this period, by 20% up to sixty days and by 50% beyond that. Once the order has been canceled, the refund will be made by bank transfer or check, which the customer accepts.

ARTICLE 3 – LEGAL GUARANTEE OF CONFORMITY
In accordance with the provisions of Articles L217-4 et seq. of the Consumer Code, the customer benefits from the legal guarantee of conformity. The company is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. In the event of non-conformity, the company shall choose between repairing or replacing the product.

In Sweden, license plates belong to the state and are issued once for the entire lifetime of the vehicle. According to Swedish law, exported vehicles must be deregistered before leaving the country.

PLEASE NOTE:
Like many countries, Sweden removes vehicles sold for export from the registration register. You must first apply for “cancellation for permanent export abroad” from the Swedish Transport Agency.

To submit the procedure for cancellation of the registration, you must make an appointment (3 to 7 days) with the Swedish Transport Agency and then provide the documents and follow the procedures below.

Tax of €8.67, except for vehicles over 15 years old from their date of registration in Sweden (cash payments are not accepted).

Identification of the interested party: Individuals: presentation of an official document certifying the identity and address of the holder (national identity card, residence card, passport, in addition to the foreigner identification number).

Vehicle documentation: registration certificate and Besiktning (technical inspection of vehicles – vehicle inspection).

The existence of a seal will prevent the deregistration from being processed, so it must be canceled before anything else. Before requesting the deregistration of the vehicle, the interested party must cancel any restrictions on disposal that may be entered in the movable property register, unless expressly agreed by the financial institution.

In the event of deregistration due to transfer to a country outside the European Union of vehicles more than four years old from the date of first registration, the technical inspection (Besiktning) must be valid.

NOTE: Additional documents may be requested and fees will be payable.

And by paying the following fees:

ACI fee: €13.50; Stamp duty: €32.00 for the Unified Application + €1.78 for postal payment:

DT fee: €10.20 + €1.78 postal payment (for both EU and non-EU exports). Once all the documentation has been verified, the applicant receives a single document, which is not valid for circulation, with a note stating that the vehicle has been taken out of circulation for export to an EU country or a third country.

You must go through the Swedish Transport Agency, which is the body that manages the register of motor vehicles in circulation and provides export license plates.

You must obtain a temporary traffic permit and license plates from the provincial motor vehicle offices in order to be able to drive to the border.

Obtain transit plates + insurance (allow for €100).

The PRA offices are closed on weekends, and depending on the office, the formalities are not always completed within a day.

How do I register a car from Sweden?
To obtain a registration certificate after importing a vehicle from Sweden, first go to your nearest tax office to request a tax clearance certificate. This document certifies that the vehicle purchased in Sweden is in compliance with VAT regulations. If the Swedish seller has not provided you with this, you must then apply online for a European Certificate of Conformity (COC). This certificate guarantees that your new vehicle complies with all applicable European standards. While waiting for the final registration certificate for your car from Sweden, which can take up to three months to arrive, we recommend that you obtain temporary WW license plates. This temporary certificate will allow you to drive freely within your country. It is valid for two months, renewable once, and can therefore last for a maximum of four months. As Sweden is located in Europe, you do not need to have your vehicle inspected again if the last inspection was less than six months ago. Vehicles less than four years old are also exempt from inspection.

What documents are required to register a Swedish vehicle?
As Sweden is located in the European Union, the formalities for obtaining a registration certificate for a car imported from Sweden are much simpler than for a country outside the EU. To obtain a tax clearance certificate, you will need to provide several documents to the tax authorities:

Proof of identity; Proof of address dated within the last 6 months;
The purchase invoice for the car The Swedish registration certificate.
You will also need to provide the Swedish vehicle registration card, to be sent to the ANTS, as well as the original declaration of sale (or the invoice if you purchased the car from a professional). This must not contain any deletions and must be signed by both the buyer and the seller. Then fill out form CERFA 13750*07 to make the official application for a registration certificate for your car from Sweden. Please note that you will also need to make several photocopies:

Your ID card (front and back) Your driver’s license The car insurance certificate A copy of the technical inspection certificate dated within the last 6 months, if necessary. You will also need to provide proof of address in your name, dated within the last 6 months.

VERY IMPORTANT NOTES:
Additional costs may arise during the process. Payment in Sweden is made by bank transfer, so you should allow at least three days between the test and receipt of the transfer.

If you wish to import a vehicle from Sweden without having to worry about the administrative procedures and documents, we strongly recommend that you use a car importer or car broker such as ourselves. We take care of everything for you, while saving you unnecessary costs.

 

ARTICLE 5
LEGAL WARRANTY AGAINST HIDDEN DEFECTS
In accordance with the provisions of Articles 1641 et seq. of the Civil Code, the company is bound by the legal warranty against hidden defects in the item sold that render it unfit for its intended use, or that diminish its use to such an extent that the customer would not have purchased it, or would have paid a lower price for it, had they been aware of them. However, the company is not liable for errors, even obvious ones, of which the customer may have been aware.

The vehicle will be delivered to you with temporary insurance valid for 14 days. The original registration certificate for your vehicle and your country’s license plate will be sent to you after the 14-day trial period.

ARTICLE 6
PERSONAL DATA PROTECTION
The company declares that it complies with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data and with the Data Protection Act. The company processes your personal data as the data controller in the context of customer file processing. In accordance with the above provisions, the customer has the right to access, rectify, transfer, erase their personal data or restrict the processing thereof, which the customer may exercise at any time via their account. The customer may also, where justified on legitimate grounds, object to the processing of their data. By agreeing to these Terms and Conditions, the Customer consents to the Company collecting and using this information.

Customers may request access to, correction or deletion of the information collected by contacting our company. The company retains data for a specified retention period so that the data is kept for a period proportional to the purpose for which it was collected.

 

ARTICLE 7
MEDIATION
These general terms and conditions are governed by European law. If difficulties arise in the application of these general terms and conditions, the customer must first contact the company to attempt to reach an amicable settlement. In the absence of an amicable settlement, any claim or dispute relating to the validity, interpretation, execution or omission, interruption or termination of the order form may be submitted to the arbitrator of the National Council of Automotive Professions (CNPA), registered on the list of arbitrators established by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the Consumer Code.

Payment of Swedish VAT is mandatory and is included in the price of the vehicle.

The Mediator can also be contacted by post using a form that can be downloaded from the Mediator’s website at the following address: M. Médiateur du Conseil National des Professions de l’Automobile (CNPA).

The Company informs you of the existence of the European Online Dispute Resolution Platform, which is designed to collect all complaints from European consumers arising from online purchases and forward them to national mediators: this platform is available at: http://ec.europa.eu/consumers/odr/.

 

ARTICLE 8
Non-rectangular
The invalidity of a non-essential contractual clause does not invalidate the other provisions. The fact that the company does not apply one or more clauses of the general terms and conditions, either temporarily or permanently, does not mean that it waives the right to invoke the other clauses of the general terms and conditions, which shall continue to apply.

Legally: delivery to the country of destination would involve crossing the border.

 

ARTICLE 9
Transfer
The Company may freely assign all or part of this Agreement to any company controlled by, controlling, or under the same control as it, in accordance with Articles L233-1 et seq. of the Commercial Code.

 

ARTICLE 10
Competent courts and applicable law
In the event of a dispute, the company and the customer undertake to attempt to resolve the dispute between them in good faith and amicably. If the attempt to resolve the dispute amicably fails, the parties may bring the dispute before a competent court. These terms and conditions are governed by Swedish law.

Article 11:

Sweden is not in the eurozone and uses the Swedish krona (SEK) as its national currency. However, this does not pose any problems: all our sales are made in euros and our euro accounts are in Spain, Portugal, and France.

 

Article 12:

FINANCING

We offer financing on vehicles with a mandatory 30% down payment. The financing term is between 12 and 60 months maximum with a 0% interest rate.
The following documents are required for all financing applications:
-National identity card or passport or driver’s license.
-Proof of address (electricity or telephone bills for the last 3 months)
-Proof of income (pay slips or other documents for the last 3 months)
